Motorola Wins German iPhone, iPad Injunction

FOSS Patents: A German court has issued an injunction banning sales of Apple's iPhone and iPad in Germany. The ruling comes in a patent infringement case brought by Motorola, which alleged that Apple's smartphones and tablets violated its patent on “method for performing a countdown function during a mobile-originated transfer for a packet radio system.” The sales ban covers all iPhone and iPads, except the iPhone 4S, because it was released after Motorola filed its case.

Apple can appeal the case, modify its products so that they no longer violate the patent in question, or try to work out a licensing deal with Motorola. If the decision stands, Apple will also owe damages to Motorola. The ruling could also have implications for Apple sales throughout the EU.
